This may fall into the “What can you do?” category, but here goes: Curious if anyone includes language in RFP responses or other new business pitch decks to attempt to protect your agency’s ideas? We recently had a potential new client choose to not move forward with us but have since seen them activate several programming ideas that our agency put forward in our pitch. Not necessarily looking to take legal action, but if anyone has experience or tips to share in this area, we’d love to hear from you!

That’s really crappy and bad form. I don’t have language, but I bet that could be drafted quickly and I’d be happy to take a look if you want another set of eyes. Here’s how we’ve started to protect our time, resources with RFPs…

We ask that as part of participating, we can expect feedback based on the outcome, regardless of how it pans out.

If and when we’re ghosted, I will often send a note to follow up and ask for that- not that they always do (hence the ask and agreement at the upfront) but I try.
